City and County of Boulder issued the following announcement on Oct. 16.
The City and County of Broomfield has determined that the ballot language for Broomfield Question 2A differs from the language sent out in the TABOR notice.
While the question of whether or not to add a sales tax to potential future marijuana sales remains the same, the estimated tax revenue on the ballot reflects a $2.2 million limit, when it should have reflected a $3.5 million limit for the first fiscal year.
The City and County Attorney’s Office has conferred with outside legal counsel and their initial assessment is that this will not invalidate Broomfield’s ability to impose the retail sales tax on marijuana, but will limit the maximum amount of revenue that can be retained to the lesser amount ($2.2 million) as it appears on the ballot for the first fiscal year. Because the ban on marijuana sales remains in effect until February and regulations are yet to be adopted, city staff feel that this will not impact future revenue if the measure passes.
After a resident brought this to the attention of election officials Friday afternoon, the City and County Clerk acknowledged the mistake and it was immediately reported to the City and County Manager, Attorney, and Secretary of State, as required by the Department of State Election Rules. A notice will be posted on each voter booth and the front doors of the Voter Service and Polling Centers before opening Monday, October 19, as well as on the website and social media throughout the course of the election.
“As Mayor and on behalf of the City Council, while we are disappointed, residents should continue to have confidence in this and future elections and feel proud to participate in the voting process,” said Broomfield Mayor Pat Quinn.
